Overview
Smilehome Inc. (hereinafter referred to as "the Company") recognizes the importance of protecting personal information, complies with the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act"), and also, We will endeavor to handle and protect the information appropriately in accordance with the following Privacy Policy (hereinafter referred to as "this Privacy Policy"). Unless otherwise specified in this Privacy Policy, the definitions of terms in this Privacy Policy are in accordance with the provisions of the Personal Information Protection Act.
Definition of Personal Information
In this privacy policy, Personal Information shall mean Personal Information defined by Article 2, Paragraph 1 of the Personal Information Protection Act.
Purpose of Using Personal Information
We use personal information for the following purposes.
- To provide our services (meaning the services provided by our company and affiliated companies that customers provide and use Personal Information to us. The same shall apply hereinafter).
- To respond to information and inquiries regarding our services.
- For information on our products and services.
- To respond to acts that violate our terms, policies, etc. (hereinafter referred to as "terms, etc.") regarding our services.
- To notify you of changes to the terms and conditions of our services.

Change of Purpose of Using Personal Information
The Company may change the purpose of using personal information to the extent reasonably recognized as relevant. If such a change occurs, the individual who is the subject of the personal information (hereinafter referred to as "the person")will be notified or publicly announced.
Restrictions on the use of Personal Information
We will not handle personal information beyond the scope necessary to achieve the purpose of use without obtaining the consent of the person, except when permitted by the Personal Information Protection Act and other Acts and regulations. However, this does not apply in the following cases.
- When required by the law.
- When it is necessary to protect the life, body or property of a person and it is difficult to obtain the consent of the person.
- When it is necessary for a national institution ,local public body, or an entrusted person to cooperate in carrying out the affairs stipulated by the laws and regulations, and such affairs are conducted with the consent of the individual, precautions will be taken to avoid any hindrance or potential risk.
- When there is a legitimate reason to exercise.
Appropriate Acquisition of Personal Information
We will properly acquire personal information and will not acquire it by deception or other improper means. Except for the following cases, we will not acquire sensitive personal information (meaning what is defined in Article 2, Paragraph 3 of the Personal Information Protection Act) without obtaining the consent of the person in advance.
- When any of the items in Paragraph 4 applies.
- The sensitive personal information is disclosed by the person, national organization, local public body, persons listed in each item of Article 76, Paragraph 1 of the Personal Information Protection Act and other persons specified by the rules of the Personal Information Protection Commission. case.
- When personal information requiring consideration that is clear on the outside is obtained by visually observing or taking a picture of the person.
- When the personal information requiring consideration is provided by a third party and the provision by the third party falls under any of the items of Paragraph 7. When receiving personal information from a third party, we will confirm the following matters in accordance with the rules of the Personal Information Protection Commission. However, this does not apply to cases where the provision of the personal information by the third party falls under any of the items of Paragraph 4 or any of the items of Paragraph 7.
- The name or address of the third party, and in the case of a corporation, the name of its representative.
- Background of acquisition of the personal information by the third party.
Security management of personal information
We will provide necessary and appropriate supervision to our employees to ensure the security of personal information against risks such as loss, destruction, falsification, and unauthorized disclosure. Additionally, when outsourcing any or all aspects of personal information handling, we will ensure proper supervision to ensure the security of personal information by the outsourcing party.
Provide-information to third parties
The Company will not provide personal information to third parties (excluding affiliated companies) without the prior consent of the individual, except in cases where any of the items in Paragraph 4 applies. However, the following cases do not correspond to the provision to the third party specified above.
- When providing personal information by entrusting all or part of the handling of personal information to the extent necessary to achieve the purpose of use.
- When personal information is provided due to the succession of business due to a merger or other reasons.
- When shared use based on the provisions of the Personal Information Protection Act.
Notwithstanding the provisions of Paragraph 7, the Company shall be a foreign country (a country designated by the rules of the Personal Information Protection Commission based on Article 24 of the Personal Information Protection Act, except for cases that fall under any of the items of Paragraph 4. Personal information is sent to a third party (excluding those who have established a system that conforms to the standards specified by the rules of the Personal Information Protection Commission based on Article 24 of the Personal Information Protection Act). When providing it, the consent of the person to approve the provision to a third party in a foreign country shall be obtained in advance.
When we provide personal information to a third party, we will create and store records in accordance with Article 25 of the Personal Information Protection Act. When receiving personal information from a third party, the Company shall make necessary confirmations in accordance with Article 26 of the Personal Information Protection Act and create and store records related to the confirmations.
Disclosure of Personal Information
When “the person” requests the disclosure of his/her own personal information based on the provisions of the Personal Information ProtectionAct, we will promptly disclose the requested information after confirming that is indeed a request from the person him/herself(if the requested personal information does not exist, we will notify the individual accordingly). However, this does not apply if the Company is not obligated to disclose the information under the Personal Information Protection Act or other applicable Acts and regulations. (Please note that there is a fee of 500 yen per case request for the disclosure of personal information, and we kindly ask for your understanding in advance.)
Correction of Personal Information
If the person requests correction, addition, or deletion (hereinafter referred to as "correction") of the content based on the provisions of the Personal Information Protection Actbecause the personal information is not true, the Company will do so. After confirming that the request was made by the person himself / herself, the necessary investigation will be conducted without delay within the range necessary to achieve the purpose of use, and based on the result, the content of personal information will be corrected to that effect. (If we decide not to make corrections, we will notify the person). However, this does not apply if the Company is not obligated to make corrections. under the Personal Information Protection Act and other Acts and regulations.
Suspension of Use of Personal Information, etc.
The Company bears responsibility if personal information of an individual is handled beyond the scope of the purpose of use that was previously announced, or if it was obtained through deception or other fraudulent means, in violation of the provisions of the Personal Information Protection Act. If a request for "suspension of use, etc." is made based on the provisions of the aforementioned Act, or if personal information is provided to a third party without the individual's consent, and if there is a valid reason for the request, the Company will promptly comply with the request. Upon confirming the validity of the request, we will suspend the use or provision of personal information and notify the individual accordingly. However, this does not apply if the Company is not obligated to suspend the use or provision under the Personal Information Protection Act or other applicable Acts and regulations.ActActActAct
